These Terms of Service ("Terms") govern your use of nogapprep.com and its practice exams (the "Service"), operated by NoGapPrep ("we," "us"). By using the Service, you agree to these Terms. This is a starting template for a pre-launch product; have it reviewed by legal counsel before accepting real payments.
1. Description of the Service
NoGapPrep provides original, independently written practice exams to help users prepare for professional certification exams. Our pilot offering is a practice exam for the ServSafe Manager food safety certification.
2. No official affiliation
NoGapPrep is not affiliated with, endorsed by, sponsored by, or otherwise connected to the National Restaurant Association, ServSafe, the ANSI National Accreditation Board (ANAB), the Conference for Food Protection (CFP), or any other certification body referenced on the Service. Any certification names used are for descriptive purposes only, to identify which certification exam our practice questions help you prepare for. "ServSafe" is a registered trademark of the National Restaurant Association Solutions, LLC.
3. No guarantee of exam results
The Service is a study aid only. Practice questions are original content and do not reproduce any official exam item bank. We do not guarantee that using the Service will result in passing any official certification exam.
4. Accounts and data
The Service currently does not require creating an account. Any name you enter is used only to personalize your on-screen results, as described in our Privacy Policy.
5. Pricing and future paid features
The Service is currently free to use while in beta. We may introduce paid plans in the future. If we do, pricing, billing terms, and refund policies will be clearly displayed before any payment is required, and these Terms will be updated accordingly.
6. Acceptable use
You agree not to misuse the Service, including attempting to disrupt it, scrape or redistribute its question bank for commercial purposes, or use it in a way that violates applicable law.
7. Intellectual property
All practice questions, explanations, text, and design on the Service are the property of NoGapPrep unless otherwise noted, and may not be copied or redistributed without permission.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, or fitness for a particular purpose. Food-safety regulations can vary by state and local jurisdiction and can change over time; always confirm current requirements with official ServSafe materials or your local health authority.
9. Limitation of liability
To the fullest extent permitted by law, NoGapPrep is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any exam outcome.
10. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. (Customize this section with your specific state of formation and preferred venue before publishing.)
11. Changes to these Terms
We may update these Terms as the Service evolves. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
